These Terms of Use ("Terms") govern your access to and use of the 250 West 85th Street website (the "Site"), operated by Pure Leasing LLC d/b/a Pure Leasing Group ("Pure Leasing Group," "we," "us," or "our"), a licensed real estate broker in the State of New York. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About the Site

The Site showcases the 250 West 85th Street building and its residences and finishes, and lets you join an interest list, request information, and schedule a tour. The Site does not process payments directly.

2. No Offer; Informational Purpose Only

All listings, prices, availability, square footage, concessions, net effective rents, photographs, videos, and descriptions on the Site are provided for general informational purposes and are subject to change or withdrawal without notice. Nothing on the Site constitutes an offer, a binding representation, or a guarantee of any specific apartment, price, term, or availability. A lease is created only by a written lease agreement signed by the landlord and tenant.

Availability changes frequently. Apartments shown may be leased, in preparation, or otherwise unavailable at any given time, and additional apartments may become available that are not yet listed. Please contact us to confirm current availability.

3. Accuracy of Information; Representative Media

We work to keep listing information accurate and current, but we do not warrant that all information is complete, accurate, or up to date at all times. Measurements and square footage are approximate. Where a video or image is identified as a "similar unit," it depicts a comparable apartment rather than the specific unit advertised; the actual apartment may differ. You should always view the actual apartment in person before entering into a lease.

4. Your Conduct

When using the Site, you agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Submit false, misleading, or fraudulent information;
• Attempt to gain unauthorized access to the Site, its admin areas, or its systems;
• Interfere with or disrupt the Site or its security; or
• Use any automated means (bots, scrapers) to access, copy, or harvest content or data from the Site without our written permission.

5. Intellectual Property

The Site and its content — including the Pure Leasing Group name and "PURE." logo, text, graphics, layout, videos, and photographs — are owned by Pure Leasing Group or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission. Property photographs and videos are protected and may not be used or reproduced without permission from the applicable copyright holder, consistent with New York real estate advertising regulations.

6. Third-Party Services and Links

The Site integrates with and links to third-party services, including Base44 (hosting) and Calendly (tour scheduling). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services or content.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT LISTING INFORMATION IS ACCURATE OR CURRENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PURE LEASING GROUP AND ITS MEMBERS, AGENTS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR RELIANCE ON ANY INFORMATION ON THE SITE.

10. Indemnification

You agree to indemnify and hold harmless Pure Leasing Group from any claims, losses, or expenses arising out of your misuse of the Site or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and post the revised Terms on this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
